Welcome to AKANENDO. The terms “we,” “us,” and “our” refer to AKANENDO. AKANENDO operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a shopping experience referred to in these Terms as the “Services.” AKANENDO is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access the Services.
Section 1: Access and Account
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence, and that you have given any required consent to allow your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information, and shipping information. You represent that the information you provide is correct, current, and complete and that you have the necessary rights to provide it.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.
Section 2: Our Products
We make reasonable efforts to represent our products accurately through photographs, descriptions, and dimensions. Colors and surface appearance may vary depending on your device, display settings, and lighting conditions.
Each AKANENDO piece is individually handmade. Subtle variations in form, dimensions, weight, clay, glaze, color, texture, throwing lines, tool marks, and other evidence of the making process may occur. Characteristics accurately photographed or disclosed on the product page are not considered defects.
Nothing in this section limits your rights if a product arrives damaged, contains a material defect, is not the item ordered, or differs materially from its product description. Please review our Returns and Refunds Policy for more information.
Product descriptions may be updated without notice. We reserve the right to discontinue products and to limit the quantities offered to any person, geographic region, or jurisdiction, subject to applicable law.
Section 3: Orders
When you place an order, you are making an offer to purchase. AKANENDO reserves the right to accept or decline an order, subject to applicable law. An order is not accepted until AKANENDO confirms acceptance and payment has been authorized and processed.
Please review your order carefully before submitting it. AKANENDO may be unable to accommodate cancellation requests after an order has been accepted. If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided when the order was placed.
Purchases are subject to our Returns and Refunds Policy.
You represent that purchases are for personal or household use and not for unauthorized commercial resale or export.
Section 4: Prices and Billing
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed and will appear in the order confirmation.
Unless expressly stated otherwise, displayed prices do not include shipping, handling, duties, customs charges, import taxes, or other charges imposed by the destination country or carrier.
Prices displayed in the online store may differ from prices offered through other authorized sales channels. Promotions may be governed by separate terms. If separate promotion terms conflict with these Terms, the promotion terms will control with respect to that promotion.
You agree to provide current, complete, and accurate purchase, payment, and account information. You agree to update your information as needed so we can complete transactions and contact you regarding your order.
You represent that the payment information you provide is accurate, that you are authorized to use the selected payment method, and that you will pay all authorized charges associated with your purchase.
Section 5: Shipping and Delivery
Processing times and carrier delivery times are estimates and are not guaranteed. AKANENDO is not responsible for carrier delays, customs processing delays, weather events, service interruptions, or other events outside our reasonable control.
Unless otherwise required by applicable law, risk of loss passes to you when the package is delivered to the address provided at checkout.
If you arrange for a package to be forwarded, reshipped, or transported after delivery to the address provided at checkout, risk of loss passes upon delivery to that original address.
Shipping, tracking, refused packages, international charges, and customer-arranged forwarding are governed by our Shipping Policy.
Section 6: Intellectual Property
The Services, including trademarks, names, text, photographs, graphics, video, audio, and the design and arrangement of those materials, are owned by AKANENDO, its affiliates, or its licensors and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, noncommercial purposes only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services without prior written permission from AKANENDO, except where permitted by applicable law.
Nothing in these Terms grants you a license or other right under any patent, trademark, copyright, or other intellectual property belonging to AKANENDO, Shopify, or a third party.
AKANENDO’s name, logos, product names, designs, and slogans may be trademarks of AKANENDO or its licensors. Shopify’s name, logo, product names, designs, and slogans are trademarks of Shopify. Other names, logos, and marks appearing through the Services belong to their respective owners.
Section 7: Optional Tools
You may be provided with access to tools or features offered by third parties that we do not monitor or control.
Access to third-party tools is provided on an “as is” and “as available” basis without warranties, representations, or endorsement. To the fullest extent permitted by law, AKANENDO is not liable for issues arising from your use of optional third-party tools.
Your use of third-party tools is at your discretion and may be subject to terms imposed by the relevant provider.
New tools, resources, or features offered through the Services will also be subject to these Terms.
Section 8: Third-Party Links
The Services may contain materials, embedded functionality, or links to websites operated by third parties. We are not responsible for evaluating or guaranteeing the content, accuracy, availability, privacy, or security of third-party materials or websites.
If you leave the Services to access a third-party website, you do so at your discretion. Review the third party’s policies and terms before engaging in a transaction.
Questions or complaints concerning third-party products or services should be directed to the applicable third party.
Section 9: Relationship With Shopify
AKANENDO is powered by Shopify, which enables us to provide the Services. Sales and purchases made through the store are made directly with AKANENDO.
By using the Services, you acknowledge that Shopify is not responsible for sales between you and AKANENDO, including injury, damage, or loss resulting from purchased products or services. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with AKANENDO.
Section 10: Privacy Policy
Personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Consumer Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes information concerning your access to and use of the Services to provide and improve the Services. Information submitted through the Services may be transmitted to Shopify and other service providers located in countries other than your country of residence.

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, reviews, proposals, plans, or other content, collectively referred to as “Feedback,” you grant AKANENDO a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for purposes connected with operating, improving, and promoting the Services.
You represent that you own or have the necessary rights to submit the Feedback, that you have disclosed any compensation or incentives associated with it, and that the Feedback complies with these Terms.
AKANENDO is not obligated to keep Feedback confidential, provide compensation for it, or respond to it.
We may monitor, edit, or remove Feedback that we reasonably determine is unlawful, offensive, defamatory, obscene, infringing, or otherwise violates these Terms.
Feedback must not violate another person’s intellectual property, privacy, publicity, or other rights. It must not contain unlawful or abusive material, malware, or misleading information about its origin. You are responsible for the Feedback you submit and its accuracy.
Section 12: Errors, Inaccuracies, and Omissions
Information made available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.
Subject to applicable law, we reserve the right to correct errors, update information, or cancel an affected order. If an order is canceled after payment has been processed, the amount charged for the canceled item or order will be refunded.

You may use the Services only for lawful purposes. You may not use the Services directly or indirectly:

An Agent may not access or interact with the Services unless it identifies itself and complies with this section. An Agent may not access the Services if AKANENDO has requested that it stop.
We may use technical measures to limit whether and how an Agent accesses or interacts with the Services.
Agents must:

We may terminate these Terms or suspend access to all or part of the Services if you violate these Terms or applicable law. You remain responsible for amounts properly due before termination.
Provisions concerning intellectual property, feedback, disclaimers, liability, indemnification, severability, governing law, privacy, and other provisions that by their nature should survive will continue after termination.
Section 16: Disclaimer of Warranties
Information presented through the Services is provided for general informational purposes. We do not guarantee that all information will always be complete, current, or error-free.
Except for warranties expressly provided by AKANENDO or required by applicable law, the Services are provided on an “as is” and “as available” basis without representations, warranties, or conditions of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement.
We do not guarantee that access to the Services will be uninterrupted, timely, secure, or error-free.
Some jurisdictions limit or prohibit the exclusion of implied warranties. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Section 17: Limitation of Liability
To the fullest extent permitted by applicable law, AKANENDO and its partners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs arising from use of the Services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including any mandatory rights or remedies provided by applicable consumer law.
Section 18: Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless AKANENDO, Shopify, and their respective affiliates, partners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from:

A failure by AKANENDO to exercise or enforce a right or provision does not waive that right or provision.
These Terms and the policies incorporated by reference constitute the entire agreement between you and AKANENDO concerning use of the Services and supersede prior agreements or communications concerning the Services.
Ambiguities will not automatically be interpreted against the drafting party.
Section 21: Assignment
You may not transfer or assign your rights or obligations under these Terms without prior written consent from AKANENDO.
AKANENDO may transfer or assign its rights and obligations in connection with a sale, reorganization, transfer of the business, or as otherwise permitted by applicable law.
Section 22: Governing Law
These Terms and any separate agreement through which AKANENDO provides the Services are governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles.
Subject to any mandatory rights provided by applicable law, disputes will be subject to the jurisdiction of the state and federal courts located in Los Angeles County, California.
If you reside in a jurisdiction that provides mandatory consumer protections, including the United Kingdom or European Economic Area, nothing in this section deprives you of those protections or any right to bring a claim in a forum permitted by applicable law.

Headings are included for convenience only and do not limit or otherwise affect these Terms.

The current version of these Terms is available on this page.
We may update these Terms to reflect changes to our practices or for operational, legal, or regulatory reasons. We will post the revised Terms on the website and provide any notice required by applicable law.
Changes will take effect on the date stated in the notice or, when no date is stated, when the revised Terms are posted. Continued use of the Services after an update constitutes acceptance only to the extent permitted by applicable law.
